1. About Streamers Nest
Streamers Nest is a parental control platform. The Streamers Nest website, applications, and related services (collectively, the "Service") let a parent or legal guardian ("you," "Parent," or "User") curate and approve which content creators their child may view, and then display only that approved content within child profiles.
Streamers Nest is a curation and parental control tool. We do not produce, own, or control the underlying creator content, and we are not a substitute for parental supervision.
2. Eligibility & Accounts
- You must be at least 18 years old and the parent or legal guardian of any child whose profile you create.
- Accounts are created and controlled by Parents. Children do not create their own accounts. Child profiles exist only within a Parent's account and are managed entirely by the Parent.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to provide accurate, current information and to keep it up to date.
3. Parental Responsibility
Streamers Nest operates on a parent-first model. This means:
- You decide which creators are approved for each child profile.
- You are solely responsible for reviewing and approving each creator before allowing your child access.
- The Service only displays creators you have chosen to approve.
- You are responsible for supervising your child's use of the Service and for configuring settings appropriate to your child.
4. No Content Guarantee
Streamers Nest reduces a child's exposure by limiting viewing to parent-approved creators. However, creator content is produced by third parties and can change at any time without notice to us.
We do not and cannot guarantee that all content from an approved creator will always be appropriate, accurate, or suitable for every child. A creator you approve may at any time post content you would not have approved. You acknowledge this risk and agree that ongoing review of approved creators remains your responsibility.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Share, sell, or transfer your account or login credentials;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with, disrupt, reverse engineer, scrape, or overload the Service;
- Use the Service to harass, abuse, or harm others; or
- Circumvent any access, security, or usage limits.
6. Billing & Payments
Paid plans are billed through our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis until you cancel.
- Fees, billing cycles, and any free-trial terms are presented at the point of purchase.
- Unless required by law or stated otherwise, payments are non-refundable.
- You may cancel at any time; cancellation takes effect at the end of the current billing period.
- We may change pricing on a going-forward basis with reasonable notice.
We do not store full payment card numbers; card data is handled by Stripe under its own terms and privacy policy.
7. Changes to the Service
Streamers Nest is evolving. We may add, modify, suspend, or remove features at any time, with or without notice. We may also update these Terms; if we make material changes, we will take reasonable steps to notify you (for example, by email or an in-app notice). Your continued use after changes take effect constitutes acceptance of the updated Terms.
8. Suspension & Termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, abused the Service, created risk or legal exposure for us, or for any other reason at our discretion. You may stop using and close your account at any time. Sections that by their nature should survive termination (including liability limits, disclaimers, indemnification, and arbitration) will survive.
9. Intellectual Property
The Service, including its software, design, logos, and the "Streamers Nest" name, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial family use, subject to these Terms. We reserve all rights not expressly granted.
10. Third-Party Content & Services
The Service displays and links to content and platforms operated by third parties (including creators and the platforms they publish on). We do not control and are not responsible for third-party content, websites, terms, or privacy practices. Your use of third-party content and platforms is governed by their own terms.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY CONTENT WILL BE APPROPRIATE OR SUITABLE FOR ANY PARTICULAR CHILD.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMERS NEST AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY CONTENT VIEWED THROUGH IT.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF FEES YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In that case, our liability is limited to the smallest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Streamers Nest and its owners, members, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your child's use of the Service, your violation of these Terms, or your violation of any law or third-party right.
14. Arbitration Agreement & Class Action Waiver
Please read this section carefully — it affects your legal rights.
You and Streamers Nest agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies.
- The arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable consumer rules.
- Class Action Waiver: Disputes will be resolved only on an individual basis. You and we waive any right to bring or participate in a class, collective, or representative action.
- The Federal Arbitration Act governs the interpretation and enforcement of this section.
15. Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Arizona.
16. General Terms
- Entire agreement: These Terms, together with our Privacy Policy and Child Safety Statement, are the entire agreement between you and us regarding the Service.
- Severability: If any provision is found unenforceable, the rest remains in effect.
- No waiver: Our failure to enforce any provision is not a waiver of it.
- Assignment: You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
